October 6, 2010 Minutes
Meeting:        Salem Licensing Board held Wednesday October 6, 2010 at 6:00 pm in the third floor conference room, 120 Washington Street. Present were members: Robert St. Pierre, Chairman, Rick Lee and John Casey. Investigator Lt. Ouellette and Melissa Pagliaro, Clerk.


Approved:       One Day Entertainment License. Applicant: Brad Backer. Present: Brad Backer.
Mr.  Backer said that he is a member of Artist Row and he has a business there as well. He said he would like to host a band at Derby Square on the steps of Old Town Hall.
Ms. Talkowsky said that the calendar is clear for that day and the City would welcome the entertainment.
Mr. Casey asked about amplification because of the residences in the area.
Mr. Backer said that it is all acoustic.
Mr. Backer also said that the event is only from 1-3pm and the band is 2 members.
Mr. Casey motioned to approve.
        Mr. Lee seconded.
Mr. St. Pierre said all were in favor. Motion carries.
        
Approved:       2 (two) One Day Liquor License. Applicant: Greater Boston Radio, Inc. Present: Adam Kline, project Manager, Crystal Margolis and Mark Keeney.  
        Mr. Kline said that he managed the event last year with the stage. He said there was live music at Washington and Federal Street. He said the intent is to provide a focal point near the fireworks display to push people out at the end of the night. He said where Halloween is on a Sunday, they thought that having the tent for two nights would help underwrite the cost and draw people to that area. He said that last call would be a t 9:15, the last person served would be at 9:30 and the tent would close at 10:00 pm.
        Mr. Lee asked about security.
        Mr. Kline said there will be extensive security. He said that Mr. David Boyle is here tonight from SBF, which is a private security.
        Mr. Kline said that there will be an 1800 sq. ft. tent with a cap of 400 people in the tent. He said everyone will be ID’d and given a wrist bands. He said there will be security staff.
        Mr. St. Pierre asked what kind of insurance they hold.
        Mr. Kline said that they have a 2million dollar liquor policy and a 5 million dollar general policy and that the serving company has a 3 million dollar policy. He said that both the serving company and the radio station are carrying liquor liability. He said that the tent will have two exits, it will be a 30x60 tent, and someone will be clicking people in and out to maintain capacity. He said it will be ticket controlled and he said that security will be at the entrance and exit.
        Mr. Casey asked how much the tickets will be.
        Mr. Kline said that the tickets will be $5.00 for a 16 oz. cup.
        Mr. Casey asked who will place the limit.
        Mr. Kline said that the security and beer serving company will.
        Mr. St. Pierre asked if all the servers were TIPS certified.
        Mr. Kline said they were.
        Mr. St. Pierre asked if the security company had reached out to the Police Department.
        FSB said that they have not yet as they were waiting for the results of tonight’s meeting but they will now.
        Mr. Kline said that all the security staff communicates by radios and there will be Salem Police details there as well.
        Mr. Lee asked how many detail officers there would be.
        Mr. Casey said the Board would like an assurance that no one will leave the tent with a drink.
        Mr. Kline said that all the sides of the tent are fenced in and there are barriers. He said that will make it hard for people to hand drinks outside the tent and there will be security at doors. He said there will be at least 8 security staff plus the police details.
        Captain Gilligan of the Salem Police Department said that he would probably require 3 or 4 detail officers for this event.
        Mr. St. Pierre said that all the Police Officers from the command post will also be in that area.
        Mr. Casey said that the written plan says that last call will be at 9:15, the last drink served at 9:30 and the tent closed by 10pm. He asked if the tent setup would stay up all night.
        Mr. Kline said it would.
        Mr. Casey asked if the beer truck would stay all night as well.
        Mr. Kline said that it would be fully locked.
        Mr. Lee said that this may prevent long lines outside at restaurants.
        Capt. Gilligan said that this would assist in his efforts. He said it has been a long standing goal to spread the crowds out. He said it will alleviate the frustration of people who stand in a line to a restaurant only to be turned away.
        Mr. St. Pierre noted that Councilor Sosnowski was present and asked him if he would like to speak.
        Councilor Sosnowski said he has already asked a lot of questions so he understands hoe this will work. He did ask if the hours will be the same for both nights. He said he thought that this would be a goof tool to control the crowds.
        Mr. Casey motioned to approve with the condition that 1 drink be served at a time.
        Mr. Lee seconded.
        Mr. St. Pierre said all were in favor. Motion carries.                  
        
                        

Approved:       Application for a Street Performers License. Applicant: Joshua Larrabee
                Mr. Lee asked what he would be doing.
                Mr. Larrabee said that he would be playing percussion.
Mr. Casey told him the rules about not passing anything for tips, the hours and that no amplification is allowed.
Mr. Casey motioned to approve.
        Mr. Lee seconded.
Mr. St. Pierre said all were in favor. Motion carries.  


Approved:       Application for a Street Performers License. Applicant: Denis Zevallos
Mr. Casey said that Ms. Pagliaro had spoken with Mr. Zevallos and he could not be here tonight but has had a license a few years in a row to play before Halloween outside the Trolley Depot. He asked if the Board could approve it.
Mr. Casey motioned to approve.
        Mr. Lee seconded.
Mr. St. Pierre said all were in favor. Motion carries.

Approved:       Application for a sub-licensee Fortunetelling License for a Sacred Place. Applicant: Patricia Gilbride. Present: Donna Caramello, owner and Pat Gilbride.
        Mr. Casey asked what Ms. Gilbride does.
        Ms. Gilbride said she has been reading tarot cards since 1979. She said she also works for a Psychic Entertainment company in Boston.  
Mr. Casey asked id she lived in Salem.
Ms. Gilbride said no that she would just read at this store.
Mr. Casey motioned to approve once BOP is done.
        Mr. Lee seconded.
Mr. St. Pierre said all were in favor. Motion carries.



Commun- 
ications:       Councilor Sosnowski asked if he may address the Board. He said that the new ordinance on the use of the Common was passed. He said that a fellow Council member implied that he does not trust the integrity of the Licensing Board. He said that is not at all the truth and that this is the one Board he absolutely trusts.  He said that he received lots of call on the Common and just wanted this space to fall under the Council.
        Mr. Casey asked him to tell the Board about the ordinance.
        Councilor Sosnowski said the Council took the mix matched ordinances from 1988, 1998 and 2003 and compared them to come up with a final piece. He said there were a lot of pieces missing and the Council put them back together.
        Mr. St. Pierre said that he saw it and it is very clear. He said there should be no misunderstandings and it should help the police as well.
        Councilor Sosnowski said it is. He said the intent was to understand the ordinance not at all to undermine the authority of this Board.
        Mr. Casey asked if this ordinance allowed for more use of alcohol on the Common.
        Councilor Sosnowski said not necessarily.
        Mr. Casey asked if past events would set precedent.
        Councilor Sosnowski said that in the future if someone had a good track record.
        Mr. St. Pierre said that the Common is such of an important park in this City.
        Mr. Lee said that not a lot of Commons match up to Salem Commons.
        Mr. Sosnowski said the intent is to protect the area.

        Ms. Pagliaro notified the Board that the Casa Blanca license has finally been approved by the ABCC for the transfer.
        New:
        Mr. Casey said that there is a new Mexican restaurant on Essex Street that has some stool seating but they do not have a C/V license. He said to call them in for the meeting on the 25th so the Board can explain the process.
